If you haven't been refunded then get on to your credit card company and lodge a dispute. Argos told me they refunded me same day but that is not the case.

Has anybody got a spare 10% discount code for Argos they have have recently had?

Willing to swap for a discount code from Unidays.

Thank you if you can help.

No way, I disagree. If the dude hasn’t had a cancellation email and the order is still pending, I’d say ride it out. When the product has launched and in stock, give it a day or two before sending Argos the “when will my delivery be” email. You never know.

it's tempting to say no hold on and wait till shipment! but they'll never send it even if the order is still active. If you want to take the (very small odds) chance, then go for it  but i'd say requesting a refund is the way to go.

6am saw the deal, booked for the Xbox to know it was going to be canceled :(:(
Money already gone out of my account I was like oh nooooo
So many thoughts running through my head. I went like no way I am going on hotukdeals for any more deals what if I have been ditched off my money :disappointed:
and then finally you all lovely people comforting me
and then a treat from Argos of 10% off
then my washing machine breaking down
and then me using the code to buy a new one from Argos!
so all smiles
love you hotukdeals community :X:X

Just read about a 10% Argos code being emailed out to people who ordered this.
I have had no contact from them since the order confirmation.
No text, no cancellation email no 10% code not a thing.

Will contact them October 3rd and see when my order is arriving as per last communication I think

Whether I clicked through from here or not makes not one jot of difference. I said I clicked through the clearance section and I did if you don't believe me that's your opinion but before you imply someone is lying have the evidence to back it up and get your facts straight. On both counts you have neither.

Thanks, I already showed them an example like this which someone had posted, still denied it!:

Visitor (10:52:02 GMT) : Here is an example of the email customers have been receiving:
Info (10:52:06 GMT) : File Transfer initiated for file : argos2.jpg
Info (10:52:09 GMT) : File sharing completed for file : argos2.jpg

She just kept going on about it was shared on a forum and not issued by Argos, I got bored before I could press her any further, this was the second rep I had spoken to cause the chat applet went down with "Ann" but she had been saying almost exactly the same thing

This should give everyone a giggle (complete denial from Argos that these codes have been issued!):

Chat transcript

Susan (10:47:46 GMT) : Hi, you're through to Argos live chat, you are chatting to Susan how can I help you today?
Visitor (10:47:55 GMT) : Ive just been speaking to Ann, theres some issue with my order apparently not containing what it says it does
Susan (10:48:10 GMT) : Ok, Can I take your name and order number ?
Visitor (10:48:10 GMT) : And that the 10% goodwill code you've sent out to people affected doesn't exist
Visitor (10:48:29 GMT) : She asked me to email an address and it has bounced back , the address doesn't exist
Visitor (10:48:35 GMT) : Starting tog et pretty agitated now as you can appreciate!
Info (10:48:39 GMT) : File Transfer initiated for file : argos.jpg
Info (10:48:43 GMT) : File sharing completed for file : argos.jpg
Visitor (10:48:49 GMT) : ^ there is my order
Susan (10:50:00 GMT) : Ok, I am sorry about that, however there is no code that myself or my team are aware of, can I ask who appropved this and what was the email address you had to send your details to ?
Visitor (10:51:26 GMT) : Ann asked me to send an email to [email protected]
Visitor (10:51:39 GMT) : It has bounced back: The email address that you entered couldn't be found. Check the address and try resending the message. If the problem continues, please contact your helpdesk.
Visitor (10:52:02 GMT) : Here is an example of the email customers have been receiving:
Info (10:52:06 GMT) : File Transfer initiated for file : argos2.jpg
Info (10:52:09 GMT) : File sharing completed for file : argos2.jpg
Susan (10:53:56 GMT) : Ok, that is an expired email address. I have spoken to our management team and this is not an offer that Argos are generating for the cancellation of the XBox orders. This has been distributed on a forum which relates to a specific cusomter
Visitor (10:55:08 GMT) : But LOTS of customers are reporting receiving this email
Visitor (10:55:11 GMT) : not just one
Susan (10:55:40 GMT) : I undestand that, this is because it has been shared on a forum
Visitor (10:55:41 GMT) : They posted telling everyone to check their email and everyone is replying saying they've got it
Visitor (10:56:38 GMT) : So you are telling me no such compensation has been offered to anyone? I can quote you on that?
Susan (10:56:39 GMT) : This is incorrect information as it does not relate to XBox orders
Susan (10:57:40 GMT) : I can confirm that this is not an offer made by Argos for the cancellation of the XBox orders, this information is provided by the management team
Susan (10:57:47 GMT) : Can I help with anything else ?
Visitor (10:57:57 GMT) : Yes, can you tell me the valid email address to contact about this?
Susan (10:58:54 GMT) : We no longer have email as part of our contact service
Visitor (10:59:13 GMT) : How bizarre. a telephone number then please
Susan (10:59:59 GMT) : of course 0345 640 2020. Email is no longer required as we have this Live Chat facility which is instant support to our customers
Visitor (11:00:53 GMT) : I'm a big fan of Live Chat yes, but the information I'm getting is contradicted by hundreds of people receiving emails from Argos, so perhaps speaking to someone will be more useful, thanks for the number
Susan (11:03:54 GMT) : No problem, however, as I have explained information can be spread without our consent by any customer and this is out of our control, as you advised this has been shared on a forum. I have confirmed this is not something we have sent, please feel free to call if you need more clarification though, have a good day
Visitor (11:04:54 GMT) : Yes, its obviously just a conspiracy by lots of customers! Take care Susan

Weirdly, I didn't receive the code (or any other email for that matter) and when I asked on webchat about it they said my order didn't have an Xbox on it at all and in any case they weren't offering any compensation to anyone anyway!

It's really up to the bank how long it takes to bounce back if it was a failed transaction as Argos never took the money as such. It's just kind of limbo between the two. so it shouldn't be more than 3-5 for any that failed.

Sales contracts

(1) A contract is a sales contract if under it—

(a) the trader transfers or agrees to transfer ownership of goods to the consumer, and

(b) the consumer pays or agrees to pay the price

Part a never took place. You have no contract.

However they took payment from my Paypal account yesterday (Mon 18th). Going to try and get through to live chat and sort out my refund.

I paid via Paypal balance so my refund should have happened the same day according to Paypal official help pages. I've spoken to Argos Helpers on Twitter but they just fob me off saying they're looking into it. My opinion is don't expect a refund for some time yet if paid via Paypal via bank account as it seems they haven't even started issuing refunds yet. So when they eventually do, wait 3-5 more working days for your bank to register it.

How much is the voucher for and is there any restrictions on it? E.g. minimum spend of £100 or only works on games/entertainment products? Or can i just spend a voucher and not pay anything for what i ordered if it's the same price as the voucher :face_with_monocle: ?
prynolfc
19 Sep 17 #1080
Is that to use on a certain category of products? And does it have to be a minimum spend of say like £100 or something to? Or is it possible to get something for like £10.99 and just pay the 0.99p ?

19 Sep 17 #1079
How are people getting the £10 gesture?
DingoDirk
19 Sep 17 #1078
The contract is formed when the offer is accepted and money changes hands. This is why most companies don't take the money until despatch - because they don't want the hassle.

In Argos' case, the contract is formed when they take the money but their Terms and Conditions govern the management of the contract. If there was no contract, the terms and conditions would be irrelevant.

The point here was that Argos took the money after cancellation. Nothing in contract law and nothing in their Terms and Conditions allowed them to do this.

On top of a pricing error was a payment error, a delayed refund and, also, a failure to even approach customers (as they state that will) to offer the goods at the correct price.

Their behaviour is arrogant and reflects badly on the large number of online retailers who don't behave in this way.
DingoDirk
19 Sep 17 #1077
I've been offered a voucher in recognition of the fact that the money was taken *after* the order was cancelled.

You can't force a supplier to provide mispriced goods. This isn't about taking advantage of a local small business shop but rather asking a huge enterprise responsible, over the years, for claiming a large part of the non online market, to accept responsibility for arrogant behaviour.

I would have not bothered contacting Argos if they hadn't taken the money in full for a pre-order. Even then I would probably have chalked it down to experience. But to cancel the order and then take money, on top of a pricing error - without even bothering to give the opportunity to pay the correct price as detailed in the Terms and Conditions - is bloody arrogance that should be challenged. To wait days after this for a refund - which needs to be chased and which oddly doesn't seem to be as automated as the taking of the money - is unacceptable.

The point in citing the Sale of Goods Act/CRA was simply that, despite the numpty views to the the contrary on here, a contract exists when the offer is accepted and money is paid - the existence of Argos Terms and Conditions is evidence that Argos accepts that there is a contract. The contract doesn't magically appear when Argos, having taken money, decides to send the goods.

So what about someone like myself who tried to place the order, on behalf of a sibling, who got a message on screen saying that the order was not successful and was not complete, no order number generated or email, yet £89.99 was taken from my account anyway? When spoken to, and provided them with an auth code from the bank, and promised that it would be back within 4 hours, this has seemed to have turned into 120 hours. Where does this stand from a legal perspective? The contract was not completed, yet due to Argos an IT 'error' happened at checkout?

What annoys me is the way Argos work. Pre-auth instantly for £89.99 that cleared the following day when the cancel sms arrived, leading you to believe that was it done an dusted. The day after that they take the £89.99. The way Argos take payment instantly for pre-orders is totally odd and pure greed.

When you say "challenge", how much effort have you actually put in? I'm gonna go out on a limb and say at worst none whatsoever and at best significantly less than you've put into trying (and failing, miserably) to prove your ill-informed point on here. If you'd bothered to get in touch with them, they would have confirmed the error, apologised and told you the refund will be with you in 3-5 days, as they have to me and several others who chose to proactively do something about it, rather than citing out-dated consumer law and mythical personal experiences
marteee
18 Sep 17 #1059
Argos will blame you and the bank will blame you. You tried to make the purchase, Argos didn't force you and nor did your bank. Can everyone stop blaming everyone else for their financial situation now? As I said to some other loon, had the mis-price come off, you would STILL "be £90 down" and wouldn't have any goods (it was a pre-order, still not available for a couple of weeks) so the situation is no different.

DingoDirk
17 Sep 17 #1051
A number of people have had money taken after the order was cancelled. The money has not been paid back. There is a problem getting the money back because the repayment does not seem to be as automatic as the initial charge and the issue needs to be escalated with Argos in order to get the money back.

Nobody can force Argos to honour the sale - although some companies do agree to honour pricing errors Argos has never been one of them.

I was sold a Nokia N95 8GB worth a few hundred Pounds for £19.99 because of a pricing error

Well, whether it does or not, it still doesn't support what you're saying. Feel free to quote that section if you like, it's pretty short. You probably won't - since it specifically says that a sales contract needs more than just the customer having paid money - which makes your argument complete nonsense (if that wasn't obvious already).

And I like how you've completely ignored the fact you were citing something that no longer applies - be a great politican!

They took the money *after* they had told me that the order was cancelled.

Separately, their terms and conditions state that they believe the contract is not fulfilled until the goods are physically supplied. That's not the same as saying there is no contract.

I am not trying to get them to honour the pre-order - there is no way of doing that.

The point is that nowhere in anything they state in their terms and conditions do they have the right to take money after cancellation.

By taking money from my account without authorisation and as a consequence of automated arrogance, they will have to acknowledge that I am now out of pocket to their advantage.

Sorry but You are talking nonscense. You had NO contract.

Also its a PRE-ORDER!!! which alot of members on here are failing to grasp.

Argos/tesco and few other companies take money for pre-orders at time of order. At no point in this a contract. You agreed to the retailers own terms and conditions when placing the order.

Just as an example of "terms and conditions" say you want to cut your hair for charity, and go to the hairdressers to get it cut. Your in the barbers chair and barber cuts your pony tail off. It hits the floof of the barber shop.
That hair is no longer yours. The barber owns it.

My brother has a law degree, by all means try taking argos to court, try getting compensation, try get them to honour this PRE ORDER, myself, yourself or any member on here hasnot got a cat in hells chance.

I don't get where you're coming from, Section 5 says:

Sales contracts

(1) A contract is a sales contract if under it—

(a) the trader transfers or agrees to transfer ownership of goods to the consumer, and

(b) the consumer pays or agrees to pay the price.

(2) A contract is a sales contract (whether or not it would be one under subsection (1)) if under the contract—

(a) goods are to be manufactured or produced and the trader agrees to supply them to the consumer,

(b) on being supplied, the goods will be owned by the consumer, and

(c) the consumer pays or agrees to pay the price.

(3) A sales contract may be conditional (see section 3(5)), but in this Part “conditional sales contract” means a sales contract under which—

(a) the price for the goods or part of it is payable by instalments, and

(b) the trader retains ownership of the goods until the conditions specified in the contract (for the payment of instalments or otherwise) are met;

and it makes no difference whether or not the consumer possesses the goods.

How do you relate any of that to this situation?

17 Sep 17 #1042
It's interesting how you're not addressing points (i.e. the content of Section 5 that you tried referencing), and then pivot the conversation to a completely different tangent - like spouting nonsense about it "proving to be a challenge" to get the money back - for a misprice that only happened on Thursday. Who are you trying to convince here?
DingoDirk
17 Sep 17 #1041
The section of Sale of Goods Act finds pretty similar expression in much harder form in section 5 Consumer Rights Act.

Other people who had money taken *after* the cancellation and want to pursue Argos for their arrogant behaviour are onto an argument with a large chance of success.

Automating systems for orders is great but it doesn't change the fact that the Argos isn't allowed to take money after cancelling an order.
DingoDirk
17 Sep 17 #1039
This is silly and you are missing the point.

Statute takes precedence over terms and conditions and section 28 Sale of Goods Act tells me - and them - I had a contract.

Why are you struggling to understand that and the fact that in taking the money after cancellation they breached their own terms?

Is it too challenging for you to understand the sequence of events?

DingoDirk
17 Sep 17 #1038
I'm not ignoring it at all - the substance is the same and "section 28 Sale of Goods Act" is just ingrained shorthand a bit like saying Sellotape for sticky tape.

No way can Argos be forced to sell a product as a consequence of a pricing error (although some companies will willingly agree).

In this case, the sausages have taken money from some people (not all) after cancellation.

Getting the money back - aside from anything else - is proving to be a challenge.

If you didn't agree to the T&C as you say, you didn't complete the purchase so you have no problem! If you did complete the purchase, YOU ACCEPTED THEIR T&C, is it that complex?

They are perfectly within their rights to take your money, then subsequently identify an error and rescind the offer PER THEIR T&C WHICH YOU ACCEPTED!! Their only obligation to you is the refund which they must do within a reasonable time.

I think you're deluded, however, let's hope your petty gamble of them not turning up doesn't end up with you having egg on your face

16 Sep 17 #1031
You assume I don't know what I'm talking about but you're wrong.

The existence of the contract is not determined by terms and conditions but rather by the existence of invitation to treat and consideration. The terms and conditions may govern the contract but they cannot argue it out of existence.

Argos has made a decision - unlike almost all online retailers - to take money before conducting diligence checks.

It is not my problem but I'm about to make it their problem.
frakison
16 Sep 17 #1030
Please don't argue about things that you clearly have no clue about (and I mean that with the greatest of respect, I'm not flaming you). Contracts are governed by terms and conditions, they form the basis of the agreement bound by the contract. This is STANDARD practise, you're getting muddled between face to face retail and e-tailers. If you don't believe those of us who have been on here and seen this umpteen times over, this is from the Citizens Advice website:

-----
Shopping onlineYour legal rights depend on something fairly tricky in the law: whether or not you have a ‘contract’.

Depending on the company’s terms and conditions, you’ll have legal rights (and a contract) either:

  • once you’ve paid for the item
  • once they’ve sent it to you

You’ll need to find the company’s terms and conditions to find out where you stand. Contact the Citizens Advice consumer helpline if you need help. It may be too tricky to work out yourself.

If you have a contract, the company can’t usually cancel your order, even if they realise they’ve sold you something at the wrong price. They’ll only be able to cancel it if it was a genuine and honest mistake on their part that you should’ve noticed.

If you don’t have a contract and someone realises they’ve told you the wrong price, they can cancel your order.
--------

As per Argos' website, their [email protected] state that contract is formed on despatch, in other words, until they physically cannot do anything about it, they can cancel. As I have said to others, imagine this was your business, or your mums, would you want to have your livelihood destroyed and lose your house over what is in essence an error?
Ashe
16 Sep 17 #1029
Oh, I was thinking more about an actual verifiable list, not something just in your head.

Also, since you're someone that talks about contract validity, legal rights, winning against traders, and citing the Sale of Goods Act - I'm a little confused as to why you're not aware that has been replaced by the Consumer Rights Act?!
DingoDirk
16 Sep 17 #1028
Didn't say anything at all - not a jot - about compelling them to sell goods.

Taking money from the account after notifying me that they were cancelling the contract because of an error, does however sound very much like a breach of the very contract they are relying on.

I've been buying online since 1992 and have won more than a few successes with traders who believe they have the right to take money before they spot a mistake.

Tackling a trader that takes money *after* spotting an incompetent mistake, isn't even a challenge.
DingoDirk
16 Sep 17 #1027
I didn't agree to any condition that rebutted the assumption in section 28 Sale of Goods Act and which allowed Argos to take money after cancelling my order.

Argos not only took my money but did so after they informed me that they had ended the contract.

Which part of offer, acceptance, consideration and breach of contract are you struggling with?

Nowhere in their terms of conditions is my acceptance of their right to charge me without delivering the goods let alone charging me after ending the contract, stated.

Argos has messed up by using an approach that hardly any other retailer takes especially with a pre-order.

I can't force them to provide me with the Xbox they have charged me for but I can spend a small amount of money on a small claims action that it's not worth them turning up to defend.

Good to see such an expert on here.

Seeing as people have been shopping on the internet for around two decades, I'm sure it'd be quite simple for you to find a vast number of examples of businesses who have been legally compelled to supply goods clearly priced in error, right?

16 Sep 17 #1025
You don't know what you're on about I'm afraid. I didn't say "existence" I said "governed", there's a BIG difference!!! The T&C govern how the contract will be administered, their T&C are clear!! You may not know it, but you know when you completed your purchase, there was a little note which said "By continuing with your purchase you are agreeing that you have read, and accept, our Terms and Conditions and have read and understood our Privacy Policy." They are protected by the very terms and conditions that YOU agreed to as part of the sale!!!

GAME OVER!!!

Do those getting notifications of a delivery due have an argument that this communication constitutes a dispatch notification therefore by not supplying the Xbox at £90 argos are in breach of contract? I and many others ended up with a £150 ps4 slim with fifa 17 last year from GAME due to them sending a dispatch notification even though it was out of stock. I don't think - and I've looked very closely - that Argos took the money from my account.

If they had taken the money I'm not sure that it would have been so simple for them to just cancel the order on the basis of E&OE.

The contract is struck when I accept the offer and they accept my offer to accept their offer.

This idea that the contract is struck only when they actually despatch the goods, is really odd.

Are they saying that I have no contract with them prior to that because if they are, that is nonsense.

But it doesn't look as if they took my money from me so all of that is academic

Fair enough, it was a long shot, would a message saying a courier will be delivering on such a date, as has been received by a number of purchasers, not constitute a dispatch notification? With the implication you can't receive something that isn't dispatched? A corrected pricing error being cancelled then that's fine, I dare say some will be expecting a delivery on the day specified by argos on the email, even though the console isn't out for weeks.

Not legally no, as has been said umpteen times on this thread, their t&c (which form the basis of any use contract) say that contract is formed ON DESPATCH. This gives them every opportunity to fix errors right up until the point of no return, i.e when it's out of the door and on its way to you. Some will offer good will gestures depending on value and numbers, but this is simply too much for Argos given the pricing difference and the number of people who have tried their luck. The moral of the story is, if you find a fantastic price error, don't post it on a forum, that way you MIGHT get lucky and get the deal

You can complain but what you fail to understand is there is nothing to stop anyone complaining but actually expecting to come away in this instance in Profit is fundamentally wrong!

YOU ARE NOT OUT OF POCKET - you tried to obtain goods that was in all fairness, a mistake and mis-priced. You knew about it yet ordered it anyway, you had no issues taking it from them knowing fine well it was an incorrect price. Even when it was made public from retailer it was an error you still purchased anyway. You were also buying an item that didn't exist for another 3 weeks.

But now you expect to be financially rewarded for their mistake, you started off with £89.99 and will finish up with £89.99 yet you were happy to have argos pick up the deficit and in turn rob employees of their wages for your cheap Xmas present.

But no, you are peeved because you cant have something that was never going to happen so now instead of just moving on you are focussing on wanting to line your own pockets with compensation and feel you are owed, this is what I fail to understand. You never moved from your backside from point of ordering to point of continuously complaining yet expect to be rewarded

WTF to that!

Compensation - GET A GRIP!!!!

Think of those unfortunate people that were happily going about there day, busy commuting probably more than likely off to work and school who didn't have time to sit on the back side b*tching like a child about not having their cheap xbox one for little Jonnys Christmas but feel they have enough time to write letters to CEOs and such like demanding reimbursing with extras, like you actually deserve it!!!!!

Yes, they do. But it doesn't change their terms and conditions. It doesn't change the law that protects them from these kinds of mistakes.

The CEO, if he even reads your letter, will know the law better than you. He will know his obligations, and sorry, but he has none when it comes to sending out a bunch of cheap games consoles that were mispriced.

Just because you feel entitled, it doesn't actually mean that you are.

We all love a misprice, and it's great when they come off. We all knew this was one of those, but do just as the rest of us have done over the years of membership here - chalk it up to experience and move on.

It's not going to happen - it has no reason to, so why waste your time?

OK, let me help you out:
Because Argos have said so
Because doing so would not help their profit statement and would pee off the shareholders who have more sway than you or I
Because others have had their cancellation emails and they would be foolish to fulfill ANY orders as doing so well just add to the negativity and result in a deluge of calls to their call centers

Do you need any more reasons as to how I came to my conclusion? I would LOVE to be proven wrong as it means people will get a bargain. However, the fact that I didn't order does not mean that in have no right to comment either to help people or point out when prime like you are dishing out misinformation.

By all means complain, I'd totally advocate that, you will likely end up with a voucher which is good but to think that ANY amount of complaining will convince Argos to take a huge profit hit is just silly, perhaps if it was one or two people they might do it, but too many (rightly) jumped in, many if which probably didn't actually want the console

They have the right yes but maybe some of us want to live in a society where people only complain when they have been genuinely put out, not because they selfishly believe they are entitled to a super cheap Xbox. For all of those complaints you are encouraging which are ridiculous those who are genuinely struggling and have a genuine reason to complain will get drowned out. Well done you.

More generalised sweeping statements. I speak from experience and have had personalised responses from directors.

For those interested in peppering the company under a mountain of paper. Avoid email a letter is less likely to be ignored. Of course it's your choice you could send both.

There isn't a question at all, what you're highlighting is a pipe dream, rather than reality. If you go into Tesco and buy a TV, then return it, the funds take around 2-3 days to be credited back to you. This will be a similar process and timeline however given the sheer volume of transactions they will have to deal with, I for one will forgive them if this takes a day or two longer than normal.

If the order had gone ahead, you would still have no goods for a month and the cash would be gone so what actually IS your claim to compensation exactly? If your cash flow is such that you were relying on this money then it begs the bigger question of what were you doing placing the order in the first place? Argos aren't accountable for our financial situations.

Ok, so I said "no amount of complaining will get you the Xbone", to which you said "how do you know that 100%". I then gave you 4 bloody good reasons and you declared them to be "sweeping statements", which by DEFINITION they weren't.

So, you're now saying that when you said that there IS a chance, what you meant is that there isn't a chance but there is more chance of that happening that flying to Pluto in the next 5 minutes? You're right, that's way over my head as it makes no sense! :raised_hand:

My reference to being childish is your comment that letters should be used, not emails, as the Directors will have to answer each one individually which will create a load of work for Argos, that's both petulant and childish as you're wantonly trying to disrupt their business.

As I keep saying (you talk about things going over heads), I am all for complaining, as long as people remain realistic in their expectations of what the end result will be.

Finally, I'm not putting words into your mouth, I am merely picking out your words and pointing out where you're wrong, you need to understand the difference.

I cant be bothered with chasing rainbows, you carry on though, just don't spread false hope.

I just said I DID place an order, thus I DO have an interest so why wouldn't I follow the thread? Your reading comprehension has a lot to answer for. Perhaps Argos will issue a modest gift voucher as an apology, I maintain an interest in case but I fully accept we will not see the product we placed orders for, it's abundantly clear (to everyone except a very small minority at least)

I think you'll find this is going over your head.

I never said anyone was guaranteed an X box I simply asked how you calculated the zero chance. You never gave a satisfactory answer because you can't. It's just your opinion, you can't see what will happen in the future. Something that would have a zero chance of happening would be something like flying to Pluto in the next five minutes.

I don't see how complaining is childish. It's just a basic right. If you don't want to complain then don't. But don't try to stop those that do.

I have also never said complaint equals getting an X box.

Putting words in my mouth is what you are doing.
frakison

Because the Directors spend all day reading emails from plebs like us? Ever heard of a PA? Regardless, any director who had the time to personally reply to petty pricing mistakes needs sacking, it will get dropped to the CS Manager

15 Sep 17 #929
Oh dear another pre judging assuming nobody.

You write an essay as though fraud has been attempted.

I for one did not know it was a pricing mistake as the last time I priced X box's they were around £200 mark. I had no idea this was supposed to be £350. I clicked on it by going through the clearance section.
I am not a gamer so am not up to date with the various packages.
If this was up at 1 pence then yes I would agree with you but it wasn't it was at a price that rightly could have been in the clearance section.

So before you get on your high horse making assumptions about things get your facts straight first.
frakison
15 Sep 17 #927
Hang on a minute, lets be clear, as I have already said, I totally advocate a letter of complaint, this was not the original issue. I simply said (with others), that there is NO WAY you will get a console for £89 by complaining, no matter how hard. You then jumped in and asked how I know that 100% and went down the childish route of inundating the Directors with letters in some misinformed logic that they will give up the consoles rather then spend the next month handwriting letters of response!!

To reiterate, as this seems to be going over your head, this has never been about the complaint, its about YOU giving false hope to people who may think that their complaint will yield a £89 console!

15 Sep 17 #926
Sorry. But you telling me doesn't mean a thing. You cannot state with 100% confidence that the chance is zero. If that were the case every barrister up and down the land could go to court 100% confident of the verdict based on one document. One has to question who really is delusional.

If it is the case you no longer have any interest with this why not go look for more hot UK deals rather than following the traditional British mentality of trying to stop and restrict others. you've made your opinions felt and if that's how you feel about the situation you won't really be interested in this thread anymore will you.

Never mind the Oct 3rd release date that was stated...just now had my Xbox One unexpectedly delivered by Argos' excellent Shutl delivery service. Poor guy had his hands full getting the Hisense 55" Curved 4K TV in the building but all good in the end. Connected it all up and playing online right now. Bit peeved that the Hisense didn't include a HDMI cable! Using my Moto G5 now to speak to cusomer services about that, but they've just informed to put any complaint in an e-mail. I suppose that gives me the opportunity to fire up the new MSI gaming laptop! Could have done without spending £166.96 on all this gear today but hey-ho...mustn't grumble.

The page doesn't even show anymore now, just get the stock message "We're making some updates to our website to make it faster and easier to shop. We'll be up and running again shortly." More like "we are making some updates to our website so you can buy under priced Xbox Ones anymore" I'd say. What's the betting when this page comes back it isn't £89.99 anymore....

I agree its extremely unlikely to get honoured the huge amount of orders they had in. That said as no one has had any cancellations yet its too early to say for certain unless argos have posted anything officially?

I had an argos mix up last year with an xbox one s preorder (when the actual s was new out) and though they didn't honour the actual console i ended up getting a £50 gift card after making a complaint, so though you almost certainly wont get the actual console those lucky enough to order may well get some other goodwill gesture in return...

Yes, because Argos don’t realise the pricing error when thousands of these orders go through their systems... :joy:

There is a reason that HUKDs bingo card is posted on this deal. It’s because comments like these are repeatedly posted in misprice deals.

For those who don’t know. You have no sales contract until it is dispatched. There is no point arguing this point by saying you was charged as the law is the law. Your payment is only half of the contract.

Anyone who phoned Argos about this deal has not “alerted” them. They knew already because it was posted on here. Millions use this site. Thousands of orders will have been placed. This will show in Argos’ systems

With misprices, nothing is guaranteed. You win some, you lose some.

That’s not always the case. I contacted Argos when a voucher code took too much off a bed I ordered. (About £50 too much). I contacted them because I needed to order a bed elsewhere if they were just going to cancel it. They told me they couldn’t see it being cancelled and the order was delivered a week later. They corrected the site that same day too.

The key to getting a misprice is to order it and if it’s in stock (not a preorder) do not post it here until yours is dispatched (pay for next day delivery too). The moment it’s posted here, your odds fall greatly and it depends solely on how many ordered. With this misprice, loads have ordered which is why Argos will likely cancel. Those calling early on may have actually secured you that deal if Argos were able to correct it sooner.

It's been mentioned a few times, the site as a whole works for 99.9% of items, but the affected deals seem blocked (you get stuck in a buffering limbo when adding to basket).

From within the thread, ones that are already in limbo (i.e. don't flame me for outing them!) are;
argos.co.uk/pro…45 £6.99 Moto G5
argos.co.uk/pro…753 £19.99 Moto G5 Plus
argos.co.uk/pro…864 £25.99 MSI Gaming Laptop
argos.co.uk/pro…819 £51.99 HP Laptop

All of those were actual items to order, rather than the Minecraft Xbone which is actually a pre-order.

I'm sure there's more, but looks like Argos has found the clangers - fingers crossed a few people got to collect them from store before Argos had time to react!

Edit: All in one PCs also stuck in the buffering limbo

Now Serle will go to their supervisor to raise the issue. Serle gets £25 bonus for detection an issue.
Supervisor looks into issue and detects 100’s of £89.99 orders all placed in a 60min window. Flags all for cancellation and save Argos £10000’s. Supervisor gets £100 bonus for detection an issue.

We all lose out. Thanks

Same logic on my post fella surely.

The logic behind taking a punt on a misprice is on very rare occasions it's honoured.

We all know the system is alrerted by 10,000 orders.

Same as many many many other misprices.

what could an individual possibly gain from ringing a company to alert them?

Each to their own but seems the definition of wasting your own time. Argos aren't going to thank them or reward them.

we all know the system is alerted.

we all know it's a misprice

we all know it's a 99% chance it's cancelled.

what are we ringing for?

Its because we are too think to know the system would be alerted, too thick to know it's a misprice?

We think its its a social duty to alert companies of misprices?

I dont think there is anything entitled or wrong in questioning what motivates these people....

It certainly wouldn’t be a “waste of their time” again seeing as that’s the sole basis of them creating that helpline.

Come on guys. Let's not turn this into a war.

It was always going to be a punt. Clearly titled as a mis-price. We've all had a go at one at some point. Won some and lost some. It's the way it is with the mis priced items, if you're not in it, you're never going to become one of the 'lucky ones' - In it to win it.

We all get a little heated sometimes when it doesn't turn out, and I suppose in a way we convince ourselves it's going to happen with little statements that aren't really justified.

My last misprice was a £250 George vac, I paid £19. I didn't expect it, it was cancelled and it still turned up. It's ok getting all the everyday low priced items at £5 off, but it's those mega deals that pay off in the end that are the satisfying ones.

Everybody tried, no harm done. If it doesn't turn out then worst case scenario you will be refunded...at some point. Apologies to those who feel I shouldn't have shared this, but it's what I do. I really hope even one person makes use of this post. Merry Christmas to you all

You obviously don't/haven't ever worked in a Customer Service role of any description.

How "obvious" it is or isn't that it's a price error is very subjective. £89.99 is still a sensible price for a piece of technology, if it was £8.99 then yes, it would be pretty obvious even to someone not au fait with technology prices that it was a mistake. At £89.99 it could easily be perceived as a special offer / stock volume reduction price by a typical consumer (I dont include the HUKDers among us in that bracket!).

As such, a nominal voucher (£5 or so) would be a typical move by the retailer to avoid any bad will from customers.

A good find but realistically Argos were never going to honour this.

I once bought a towel set, from Argos, for a couple of quid a towel and someone got in contact with me saying that it was a mis-price and if I'd still like them I can pay for them but it would be 10x the price. Swiftly told them to jog on!

They took the money straight after ordering and it took about 3 working days to get back.
marteee

Not sure why everyone is so certain its so beyond the realms of possibility for them to honour this. Remember Vodafone recently honouring the Samsung VR error and giving away tens of thousnands of units for NOTHING?

I got an order in an hour or so ago, I think they were already on their way to sorting it though because I couldnt order the item on its own. Added a controller accessory and then it worked but at the final checkout stage it implied only the extra item was ordered. When the order confirmation came through it was the full amount and both items - so I dont even know if im "in it to win it" at this stage!

For your info if you are not aware sir, there has been certain occasions one or two people have called companies to ask if they will get their items. Further more certain companies do honour it. I have been honoured few things, 1 which was the t-mobile glitch. 0.00p per month for 250min, 250text and 500mb. I guess you've never been involved in marketing? This might be the case if this was some site that no one had ever head of. But the idea that argos marketing dept. are deliberately misleading people to 'draw people in' is such a nonsense I can't believe people actually think it.

Firstly they put themselves at risk of legal action, secondly this generates bad will not good will. It makes them look like amateurs, where as they obviously want to be seen as a one of the UK's most established retailers that people can trust.

Secondly the clicks on this (that generate bad will anyway) are so tiny in the great scheme of things as to likely be irrelevant to their bottom line. Even if EVERY person bought something else after buying this, it would be impossible to quantify the damage done when all those people get a cancelled order. They may never return again.

Do you see why as a marketing campaign it's impossible to sell? There's reason they run nationally advertised £5 off over £50 Etc.

Honestly the comments on here never cease to amaze me. It's like being in a room with a bunch of conspiracy theorists. smh

this is a pricing error which is currently in the process of being updated. The correct price is £349.99, apologies we will not be honouring this price. If you have placed a successful order you be contacted to advise the order has been cancelled and refunded. If you have not received any confirmation for this order it is likely the order was not successfully completed and any pending payments on your account will be automatically refunded. ~ Lisa

I don't think it really matters whether people tried to order one or ten - they'd have picked up on it and refused to honour as per their terms and conditions. You wonder whether they do things like this on purpose to drum up interest as lets be honest, there should be enough systems in place to make sure they price something correctly and how many people would have clicked on it at £350?

It's possible. I've been charged for 4 even though I only ordered 2 on my bank account. No idea if my credit card has been charged but I tried that a couple times too. Wouldn't even let me log in on paypal so that should be fine.

Been charged but not showing on my account as an order and no email. Am I right in thinking the contract is only considered good once the item is dispatched? By which I mean if I say nothing until after the 3rd October will they have to honour it as they have technically charged me? Just a thought. But no, not holding my breath!

Dear santa,

I've been a very good boy this year. There have been many deals posted on hukd but I've managed to behave and control myself.
The Samsung S8 came up. But I said no, no!
The note 8 came. But I said no, no!

Now that this deal has been posted, I have no option but to say yes please!

Santa, please, please please have a word with your elves over at Argos and and get them to fulfil my order.

Thank you

Love,
K

they should honour all the sales at that price though!!
Argos is a big company and can more than afford to cover the loss of money from their price mistake!! Poor show argos, the amount of traffic to their website today because of this could have gained them a good lot of other sales anyway.

Why are people so salty over this? For them to honour it, they would lose hundreds of thousands of pounds with the volumes ordered. Some times companies will take the hit and honour a price glitch, but this would be under cost, most likely a loss of £150 a unit, sure they would garner some goodwill for honouring it but that would never translate and make up the shortfall.
Don't get me wrong a small token apology would have been nice!

Are you for Real?!?!
You knowingly spent £89.99 on an item which wasn't even in stock, as it was a Pre Order, hopefully you realised that it wasn't even due to be released until NEXT MONTH. Yet now are moaning about having to wait for you pending transaction to go back on your card when you knew from vast comments it was never going to happen anyway.

You do realise most retailers bar 2 take money upfront for all preorders, should be glad that they don't make you wait until October and cancel, you would knowingly be 3 weeks without your £89.99

The law also protects retailers from misprices where it should have been clearly to the consumer this was the case. The fact that he most likely ordered based on information in this thread which the title includes the word Misprice shows he knowingly bought the item at the wrong price. Anyone stupid enough to actually take Argos to court would be foolish as all Argos would have to do is show this thread as evidence that the Misprice was well known and being taken advantage of to the detriment of their business.

Super! I had issues this morning at @ 7.40 placing an order so tried 4 times all seemingly without success, problem placing order message and no confirmation emails etc. Just checked online bank account at 4 lots of £89.99 has been taken, called CS and told have to wait for Argos to contact me which will take 48-72hrs so now out of pocket £360 and I only wanted to chance £90, nothing showing in my online account order history either, guess I will have a battle to get my money back now...

But the money has been taken from the bank as confirmed by a phone call to my bank. Phoned Argos and they said the money will be returned to me within 24-48 hours.

So as far as I can tell all I've done is reduced the available balance in my bank account for two days.

I'd hope my history would show I am not a troll. The pre order was definitely a price error, and was for a future item and date. These other misprinted items at 9:30 am weren't on the radar at that time so I'm presuming that Argos either weren't aware at this point, or were aware but had yet to make stores aware of particulars.

As with many glitches, etc, if you scream it from the rooftops, it WILL get patched and closed. If you keep it to yourself, it'll likely be there for a longer time, before getting closed

You could say, 'why didnt they check it in the first place', they are both reasonable questions BUT worthless in law.

As I always say on threads like this (and there have been many!), try to think if it was YOUR company, would you just honour a load of misprices? woud you want the law to force you to do that? There are so many products at Argos, its not hard to see why they make errors, this is exactly why ALL sensible e-tailers will include the "contract formed on despatch"

What do they "need to get out of", their T&C are definitive, contract formed on despatch.. i.e. when they cant do anything about it. This reminds me of the geat 'Pixmania TV' row of 2011, everyone was CERTAIN they had a case, they even had a "lawyer" who was going to lead the group action.... guess how many got a TV? (I'll give you hint, it was less than 1!)

As Buzz said, these are ALWAYS worth a shot, but FFS please dont wind yourself up with ideas of forcing this price, unless you get this in your hands, you have NO chance, save yourself the heartache

Biddy2
14 Sep 17 #302
Loss of Bargain is a legal rule that damages paid to the aggrieved party in a breach of contract case, should be sufficient in amount to put that party in a position it would have been had the breach not occurred. Argos aren’t in breach of contract for you to claim unfair contract terms yet as they haven’t dispatched the item. There is no contract and therefore, you can’t claim Loss of Bargain.

By all means, pursue it, but the law is very clear on the matter.

For sure - I am a king at time wasting.... Just got off the phone to argos.

Apparently its a misprice and it isn't really £89.99 and the system let them know and they wont be honouring the deals.

Just off to post some sensible, intelligent comments on the comment section of the Daily Mail site to just round off a morning of time wasting.

Also your comment pointing out that me pointing out that some else is wasting time is wasting time is also wasting time......

damn this is a vicious cycle... as my response to your response is also time wasting....

Ahhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhh

is all Buzz's fault....

damn him to hell.

There were Laptops, iPads, and other products that were very clearly priced up wrong on the website today. All available for immediate pick up. Paid online and picked up 20 minutes later, so I’m a happy boy.

Website is now down for maintenance so it looks like they’ve resolving a pretty big issue!

100% agree on a misprice you personally spot.
But on a 10000+ heat deal on here that 100s have ordered.... different story.
each to their own.

My logic is have a punt or dont.
We know 99% of the time it won't be honoured.

No one with half a brain needed it confirming this was a misprice and an error

It's like a pork chop being thrown into a piranha filled pond when a misprice comes up.

Alwaysamazes me 1) people expect to have the price honoured, and 2) the op posts the deal. Maybe just one deal will get through. But a spike of orders in the thousands? They're going to be made aware of that and shut it down.

Well. That’s my point. They can’t formulate terms that are against the basis of how a contract is formed by law. The same way they can’t make consumer rights unavailable through their T&Cs. I’m not quite sure looking at that paragraph in their T&C where they indicate a contract is formed. Like I said, I’m pretty sure the law sees an agreement being made online when a customer clicks order and consequently only when the retailer chargers against the card. This is the basis of how the law sees a creation of a contract, regardless of what T&Cs there are. I’m fully aware that I may be wrong. But I’ll contact Trading Standards to confirm later.

Can't see Argos honouring this but hey, I tried! First order seemed to go through fine but I didn't receive an order confirmation email and the order wasn't showing when I checked my account. Tried again only to fail with the "unable to process payment" type messages on two cards and PayPal, but managed to get a final try through, complete with an order confirmation email. I've just checked my account and two orders are now showing (still only one email though). I don't want two (slimmest chance ever they'd be honoured anyway) so going to cancel the one order, although Argos will probably do that for me

So I went through checkout, managed to submit my card details, it went through the card verification page, but then a message came up saying they couldn't process the order, yet the money HAS LEFT my bank. Anyone with any ideas what generally happens when Argos do this?

Even if I choose an argos card it's "unable to process my payment" so I'm guessing they've cottoned onto it.

Thanks for placing your order.

Unfortunately, we can't confirm your order at the moment but we'll send you an email shortly (this may take a couple of hours during busy periods).

There's no need to re-submit your order.

Pretty sure the charging of a card against a purchase is what forms the contract. I don’t think it’s that easy for them to simply cancel given they have already accepted the terms from their side. In any case, it might be worth having the Trading Standards consumer advice number handy: ‭0345 404 0506‬
