They opened it, switched it on, then repackaged it. That sounds like 2nd hand to me..

During the original process of manufacture the sets are switched on, tested and packaged.

not really. they must of tested it for a reason at the retailer. usually they just send them out unopened. manufacturers obviously need to test them before boxing them up and shipping them out but they should then remain unopened until the buyer sets it up at home.
so you have to wonder what that reason was, i certainly wouldn't pay anywhere near full price for such a set.

Would never buy TV off eBay, because i fear it would muddle your SOGA/CPA rights for the fact that you're not contracting directly with with the retailer but via eBay acting as a proxy instead.
Although Im happy to be proved wrong if there's case law of someone successfully suing an eBay seller under the six year fit for purpose rule...

so you have to wonder what that reason was, i certainly wouldn't pay anywhere near full price for such a set.
This was a bargain for sure.
