Errr the rules as implemented are unenforceable. Which means the person who posted is well within their rights to go on holiday.
Its a little like private parking tickets. Unless of course you feel that everyone should pay up regardless of the law?
The guy should file small claims case against the local authority & should win it.
Its nothing but a disgraceful powertrip on behalf of the council to behave in such a manner. They should also file costs against the council,

I was fined £120 for taking my child out of school for 5 days last june despite having a 95% attendance record including the holiday time off. I work in the emergency services and was unable to get time off in the holidays but this plea fell on deaf ears:(

Deserves you right! You knew the risk before you took him/her out of school depriving them of education for a week. Imagine if everyone did that, the school would struggle to manage that. Being in emergency services doesn't give you the right to do what you want and you should also know that rules are rules! Maybe plan your annual leave better next year love? Great deal OP !!

We are in Scotland and we have been told by the headteacher that they will not do anything if you want to take your child out of school for a family holiday.
I am a high school teacher and I would happily take my children out of school the last 2 or 3 days of term to go on holiday. I wouldnt take them out a full week in the middle of the term though, just last 2/3 days.

I work in a school and if a child misses 15 sessions (am+pm) due to unauthorised absence per half term, parents receive a warming about a fine. If this gets to 20 sessions (10 full days) in a half term, the council will issue a fine. They will fine every parent written on the enrolment form - £60 a go. They do this because everyone would take a £60 hit for the overall saving, but £120 changes things...

The authorisation has to come from the Head Teacher. You need to write a letter explaining the situation and the time required and also put why out of term holidays are not appropriate.
Head teachers are no longer allowed to grant Leave for Holidays in term time, but they can allow "Exceptional leave of absence"
We gambled with a Florida holiday last year. The holiday cost so much that paying a couple of hundred extra wouldn't stop us. Didn't get fined, but that's the gamble.
Wouldn't do it for a budget holiday. Fines could cost nearly as much as much as the holiday.
Lots of people seem to get on a high horse with this topic. I wouldn't judge anyone if they wanted a week away at a good price. Holidays are big part of growing up.
IE so long as its not a holiday every other month or the kids often are off there is no legal reason for the school or authority to fine anyone.

How did you get the letter and from whom? As my son is too autistic and he cannot cope with crowd and it's been difficult for us as our daughter is too in different school. My son goes special needs school too

I have not personally taken my kids out of school (my wife is teacher at the same school so it would be extra bad) but I know people who have and they have not been fined but they are friends with the head teacher.

yes I'm a single parent and took my 2 children away last year. I not only got fined £60 per child but my ex husband was also sent the same fine which I was abliged to pay sins he had nothing to do with the holiday so ended up paying a total of £240! still a good few hundred pounds cheaper than going on holiday during the school breaks.

My children go to 2 schools, my son has Autism and attends a special needs school, he got a letter saying it is acceptable to take term time holidays as he would struggle in busier times, like summer holidays.
My daughters school has to accept the ruling too even though it is a different school because it is a (I hate this phrase) "Human right to family life".
They both decline the "Absence request" but authorise an "Exceptional leave of absence"

there was a recent court case where the fine was thrown out because the child up to the point hadnt missed a day so was attending school regularly so the parent proved their child had a regular education.

It should be more about ethics then fines. If a school and an education is provided by government at a great cost to the tax payer, it would be nice if the children attended.
