No, they're not avoiding any VAT - they're selling something not buying something. EU law changed such that vendors have to charge VAT at the rate in the country of consumption not the country of sale. Crazy rule but that's the EU for you. They did it to stop people flogging stuff from Luxembourg and other places at low tax rates which made it even harder for companies in say the UK to compete. Like when you used to buy DVDs from Play.com and they always came from Jersey. Same thing. HTH. Barbs

Thanks, it’s crazy, I had a deal with a guy over in Ireland and under the agreement we had there was a VAT exemption code. I wondered if it worked in a similar fashion for Amazon.

EC VAT is fairly complex. The seller becomes the buyer for VAT purposes or something. Fortunately it's something I don't have to deal with but basically they're not avoiding VAT.
It get's even more complex when it comes to used goods and the seller is operating under the margins scheme. Potentially you can't reclaim the VAT unless they have a pool of items in which they purchased vatable goods from a VAT registered business. But a lot of resellers buy their goods from private individuals.

Well business to business can be different. You can sell services (not so sure about goods) to another business and not charge VAT as long as your buyer gives you their local VAT registration details. Then when you complete the quarterly VAT return you are legally obliged to identify that purchaser and their VAT number on an EC Sales list. The buyer will then get a VAT bill from their own country. That's how it used to work. This should not be construed as professional advice which I am not able to give. All the best. Barbs

30 days isn't the warranty, it's a return period should you change your mind. You still get a full warranty with Amazon UK warehouse.

Hmm.. I was thinking the same why UK has only got 1 year warranty on most stuff, when I moved over here some time ago. To me its normal to get 2 years warranty on stuff - this is thanks to EU, not sure why UK isn't included.
Only thing is, because its amazon that has put that statement on their website, I would trust it.

Confirmation from a customer who has had an issue with a product within the 2 year period.
I know in theory everything comes with a 2 year warranty if sold in the EU, but this can sometimes be hard to get fulfilled
In all the deals from the other EU Amazon websites, I have never seen anyone mention a 2 year warranty on new or warehouse items, I can't see why the terms would be different to the UK website, hence my initial question incase I had misread.

it was around £20 including £150 cover. £20 refunded back by amazon without any issues. you may ask why so low cover - I believe they don't want to lost anything that has any cover on, I may be wrong but it worked - phone got there in a weeks time and got refunded the following day.

Each country has its different restrictions even when in the EU. I posted an Amazon.de deal months back and unfortunately started to realise that members where having trouble returning their faulty phone to Germany with insurance. Haven't seen this anywhere on their website. They state that it's fine to send mobile phone to Italy with battery fitted inside the device.
You can indeed but you need to insist at the post office that this is fine to do. I took it to post office, paid for it, explain what's inside and then was told that it's not going. Although on their website it says, again, that it's fine to send phone with battery inside it.
Everyone panics about it being a phone.
Also cover on this is about £250 but, as I mentioned in other comments, don't think RM wants to lose anything insured.

I have just read Royal Mails restricted items page for Italy and as of 8/9/2017 it is no longer restricted. So you can use Royal mail to send but you need to look into it further as to whether you can insure it. Good luck with speaking to Royal Mail as quite often they are not aware of their own T&Cs, they will often refuse to send a mobile stating that the battery is prohibited because they dont understand the restrictions enough, ie the differences between Lithium batteries and Lithium ion batteries, the first is usually restricted/prohibited whereas the second isnt.

26 Sep 17#46
Its a "mobile phone with a battery "its a restricted item where couriers are concerned and must meet packaging requirements. As I already mentioned not all couriers will insure it, some wont even send it.The phone being an EU phone makes no difference.I see you liking every comment that opposes my warning so I suggest you read up on it and take heed.

According to Parcelforces prohibited and restricted items, mobile phones must be sent via the Post Office only, and presented at the counter so going by that it will cost about £53 insured using the Royal mail pricing for Parcelforce.

I read on the translated Amazon.it terms for warehouse items that they are covered for 24 months from purchase date against manufacturers defects.

Thank you OP. Ordered the silver just like new Totale Ordine: EUR 454,70 works out at 398.75 British Pound. If possible use the Halifax Zero Clarity card to save any additional fees. Well chuffed. Been looking on social media, (Gumtree) for one of these for a while and the sellers who have a brand new handset are looking £550+ and used with no receipt are looking £400+ At least with Amazon you would like to think that there would be some sort of come back if it ever did go wrong.

If my experience with other EU Amazons is anything to go by, they will apply UK 20% VAT to the sale, not the relevant country's VAT. Levying the importing country VAT rate is a legal requirement - see here
