This is refurbished and grade b so will have signs of use but does have 6 month guarantee. If it was particularly savage on delivery then it's a straightforward return.
The "new" nintendo 3ds xl is the latest version, brand new these are between £170-180.

Does anyone know if the firmware on this is exploitable?

All firmware is exploitable.
If it's on 11.4 or 11.5, you'll need a second hacked 3DS or specific games, or a hardmod to hack it.
If it's on 11.3 or less, you can softmod it.
So it's a bit of a gamble. All New 2DS XL consoles will be on 11.4 but who knows, maybe a hack will become available upon release.

£110 at cex with 12 month warranty, argos ebay customer service is horrible

Any warranty sold on eBay isn't really worth the "paper" its written on when eBay really don't care and therefore will do nothing about it if the seller is awkward/doesn't reply.

It's actually 24 month warranty with CeX on all non-consumable items

Refurb + Argos = Avoid!
Never had good experience with electronics this way, eg Tablet with 3rd of screen not working, phone with non-working buttons. They probably just take customer returns, don't check them and sell them on,

When I worked for a sports shoe company we would get returns from Argos. We would receive returns for other companies as well like toasters, kettles etc. along with our goods. My point is it looks like they don't do a right lot of checking in general.

It's called the "new" 3ds to distinguish it from the previous 3ds, yeah blame Nintendo for that one...

If it's fully refurbed and now looks like grade b, god knows what sort of state it was in before the refurb.
2dsxl is new, comes with charger and just £10 more if sold for list price. Only does not have 3d.

To be honest I didn't know the 2ds xl would be that cheap, I can find it for £20 more at £129.99 but as you say includes adapter. If you're not bothered about 3d that looks a cracker.

I'm amazed at how well 'new'3DSXLs have held their price, I got mine for £130 shortly after release!
Edit: Just read the OP, why have the prices increased since release?

You got a "new" 3ds xl for £130? Pretty sure the xl has always been around the £180 mark brand new, was it a cheap buy it now on ebay or something? The "new" 3ds not xl version was around £130ish from memory.

Fount the receipt, it was £160 from Tesco Direct with £20 off spend over £150, bringing the price to £140. There's another -£10 on the receipt probably a personal discount, it was May 2015.

Fair enough that was cheap with the voucher and such. I can see nintendo bringing the price back down when the 2ds xl is out as this isn't worth £50 more than that (as of current rrp anyway). Same screens and internals just doesn't have 3d that most people turn off anyway.

I got mine this morning.
I had thought that it would be a new unit, customer return, and refurbished. I think it is instead a Mazuma type second hand unit. There is a scratch on the bottom screen of mine and the stylus is particularly worn so won't stay in the unit.
I am not sure it is such a good buy.

Mine came yesterday without a stylus and with scratches. I might end up returning it and buying a 2DSXL. I wouldve if I'd known it would be in this condition.

Looking at 2ds xl myself but slightly disappointed by the lack of bundles available, especially in comparison to the regular 2ds which although it's ugly as sin, seems to have a built in game of some sort as standard as well as being cheap.
This looks a decent deal but above comments regarding argos ebay have put me off this particular one
