So I got me a key a week ago from one of these deals, paid 3.05. Have had trouble installing the x64 version and I was feeling somewhat adventurous - so I contacted Microsoft through online chat to sort me out. They've asked for the product code... than said I shouldn't have any trouble installing the x64 version and gave me the link. Now, given that the responses were nearly instant, I doubt anyone ran any kind of checks, and perhaps at some point in the future I'll get the dreaded prompt - but for now it works.

This auction was for a key applied to a Microsoft account. The software was downloaded through the Microsoft site, you have just as much a chance of malware as the buyers of these keys

It was, I got the answer I wanted within 48hrs! I'm glad I paid £229.99 for my copy rest assured that it contains no malware or backdoors into my iMAC. I doubt yours will still be working after 90 days!

I think all he's saying is that this is a court ruling based on applicable laws. Not law in itself, and clearly doesn't supersede national laws, so if the same case was brought in the UK we simply don't know for certain what the outcome would be. If so, it's correct, and a fact, not a point of view. A precedent exists but it's still a grey area.

You also mentioned these being corporate keys which aren't covered by the EU ruling if sold like this anyway (same for MSDN and other volume licensing), and that makes your argument very confusing.

The right to resell software under the EU ruling does not allow you to change the terms of the license.

Under this ruling OEM keys must still be sold with hardware. If they have ever been linked to a particular machine, they must be sold with that machine. Another grey area is Ebay policy allowing sellers to get away with sending just a broken motherboard. However, most of these cheap sellers do not even do this, and their keys aren't OEM anyway.

There's a few more things that could be pointed out, but I'll leave it at that. HTH

the European Court of Justice, the EU's highest court, decisively rejected Oracle's arguments.

"It makes no difference whether the copy of the computer program was made available by means of a download from the rightholder’s website or by means of a material medium such as a CD-ROM or DVD," the court ruled. "Even if the rightholder formally separates the customer’s right to use the copy of the program supplied from the operation of transferring the copy of the program to the customer on a material medium, the operation of downloading from that medium a copy of the computer program and that of concluding a license agreement remain inseparable from the point of view of the acquirer."

The court noted that if it accepted Oracle's argument, then "suppliers would merely have to call the contract a ‘license’ rather than a ‘sale’ in order to circumvent the rule of exhaustion and divest it of all scope."

"From an economic point of view, the sale of a computer program on CD-ROM or DVD and the sale of a program by downloading from the internet are similar," the court ruled. "The on-line transmission method is the functional equivalent of the supply of a material medium."

The court also rejected Oracle's contention that even if the original software license was transferable, the new owner was not entitled to use the free updates Oracle supplied with the software.

As for understanding the ruling. Here is the end of the ruling as taken from the European Court of Justice's own page

87 Moreover, a copyright holder such as Oracle is entitled, in the event of the resale of a user licence entailing the resale of a copy of a computer program downloaded from his website, to ensure by all technical means at his disposal that the copy still in the hands of the reseller is made unusable.

88 It follows from the foregoing that the answer to Questions 1 and 3 is that Articles 4(2) and 5(1) of Directive 2009/24 must be interpreted as meaning that, in the event of the resale of a user licence entailing the resale of a copy of a computer program downloaded from the copyright holder’s website, that licence having originally been granted by that rightholder to the first acquirer for an unlimited period in return for payment of a fee intended to enable the rightholder to obtain a remuneration corresponding to the economic value of that copy of his work, the second acquirer of the licence, as well as any subsequent acquirer of it, will be able to rely on the exhaustion of the distribution right under Article 4(2) of that directive, and hence be regarded as lawful acquirers of a copy of a computer program within the meaning of Article 5(1) of that directive and benefit from the right of reproduction provided for in that provision.

Wow, crazy post. So, people will stop coming to this site because they aren't allowed to post dodgy/scam deals? Either way you're wrong anyway. Mods on here don't remove deal links. If they don't approve of a deal, the whole post will disappear, not just the link. Although I think they can be a tad ridiculous sometimes, it results in a much safer environment. Better safe than fair. If we could post anything this site would have died a long time ago.

Should this post be allowed on here at all? At the absolute best it's grey market, and this isn't the place to advertise grey market goods. And, that's only if these are truly OEM keys which is quite unlikely. People on here trust the deals posted, and this really lets them down.

To believe these are OEM keys just because they say so is naive. Most MS software listed on Ebay has always been volume/msdn/technet licensing (often stolen), but obviously they don't say that, and those keys are illegal to sell. Ebay cover themselves by requiring the seller to provide the original hardware with any OEM key sales in their policy. But then most sellers will quote the policy to get listed with no hardware being actually delivered, or randomly even if it is. EU law is irrelevant if the seller is lying.

Did anyone who ordered this get a broken piece of computer in the post?

Yes, the keys will work (mostly) for a period of time and it's a good deal if you don't mind the fact that the vast majority are stolen.

This is not a moral high ground post. I have quite happily used activators and other means in the past. I don't mind admitting that and would do so again before paying for this.

Usedsoft are a German reseller of corporate licences. They indeed won a case against Oracle in the German supreme courts and they are spreading across the EU. There is (was) nothing to stop them trading in the UK, and I suspect that Brexit may change their minds if they planned too, as the EU ruling won't hold here after we leave.

But you have had one use here

I would assume people who purchased one key registered on more than one machine.
My key ended -TVJ92.

Well I bought it, sent an email with a link and security code.

Downloaded and installed.

Entered code without my account until I used Outlook and used my Microsoft email.

Working ok and gives my 2010 a fresh new look.

Don't know how long it will work but seems ok.

Have not tried it on other computer.

After purchasing, did you notice that you do need to associate the key with a Microsoft account? So my description was not misinformation, without doing this Microsoft will not issue you the download link or allow activation.

Unlikely, Corporate Machines will be using volume licence keys, not OEM keys. When the PC is disposed of the licence goes back to the pool in the company for re-use, or the replacement PC for the employee gets the same licence just on a new box.


There is no such thing a EU Law. The EU can make regulations and directives but they then have to be transposed into UK law to become valid in the UK.
Until there is a UK case to push it into UK law its still a gray area. Look at it another way, if UsedSoft (who took Oracle to the EU high courts) were so confident this is a valid ruling throughout the EU why do they not trade in the UK?

it was a little tongue in cheek i.e. you asked if I was a drunk idiot at parties etc so I just retorted with a few facts about me which I knew full well would irritate you...quid pro quo, and all that!

Also, my comment on the laptop thread was a genuine one i.e. pointing out there are ways to save a fortune if people can exert a little patience. I think my GT80 was one of the best bargains I have ever purchases....£1,000 off the retail price and was barely a few weeks old.

Honestly and genuinely, I don't care what you do or don't do but you seem to be totally missing the point: you 'had a go' first, so I called you on it which you didn't take kindly to - so I guess the moral of the story for you is 'don't dish it out if you can't take it'. As to arrogance, I think most people would find talking about salary and possessions quite vulgar and not socially acceptable. I never needed to know anything beyond that, and if you read back to the start, maybe you'll see it from the other side (maybe not).

The mod that removed the link to the £4 one. Be aware that this is a public site and that your site relies on its fairness to keep its confidence by its members. The link was to an OEM copy. The copies are lawful, only breaching an EULA which is not enforceable. You really need to understand the EU ruling on reusing electronic goods before you willy nilly remove links. Members try to help each other achieve bargains on here. Removing legitimate links is the way that places like China work. It's is authoritarian and quite frankly a ridiculous attempt at control of free will and free speech. If you don't want people to share stuff, then convert the site to a non-posting billboard. Your membership will of course dwindle to zero, but you can be authoritarian all you like then. Learn commercial law before you remove perfectly legitimate links

To find others selling them, just use the search engine on eBay, search for office 2016 pro and loads will come up. Check the wording, making sure you are buying one that states its OEM not one that just uses a key generator (those are illegal and could result in legal action) and check their feedback to ensure the keys are activating (key gen ones get blocked quickly)

They are an alternative legit. The keys are usually from deceased systems with corporate licences. Under EU law, these licences can be re-used but they do breach the EULA which isn't legally enforceable. EBay remove the listings because they are scared they may get sued although it's unlikely. Also the US put pressure on them threatening to block them there (again unlikely). Buying these keys is lawful. Because the re-use branches the EULA, technically the key could get blocked, and probably one day will do, but that's likely to be quite some time after and for less than a tenner, you can't get a 365 subscription for that value, so I reckon it's good value to take a punt on (especially the one selling for just £4)

eBay Policy States:
"OEM, bundled, or recovery software may be listed only if it is included along with the original hardware, such as the motherboard, hard drive, or computer sold with the OEM software." - Therefore, this sale includes the original broken beyond economical repair computer and motherboard.
Microsoft Policy States:
"Large brand-name computer manufacturers, such as Dell and Compaq, often include OEM software on non-holographic “recovery” or “reinstallation” discs that show the manufacturer’s brand name. These software packages are typically marked with a phrase that states, for instance, “For Distribution with a new Dell PC only.” Recovery or reinstallation software is licensed only for distribution with new computers and can be redistributed only with the computer for which it was initially distributed. Distributing such software with individual PC hardware components (e.g. hard drive; RAM) does not comply with Microsoft’s OEM distribution requirements." - Therefore, this sale includes the original computer from which the COA was taken off.
OEM Software:
Microsoft's Distribution Agreement for System Builders states that the system builder software packs are not intended for distribution to end users unless the end users are acting as system builders by assembling their own PCs. A "system builder" is anyone who assembles, reassembles or installs software on a new or used computer system.

If people want to buy these codes, let them. Where these come from is questionable though. If anyone buying these codes really believe these are legal, contact MS and ask them who the code is registered to (I'm guessing a company or an MSDN subscription) and say you've bought it for £7 and is it legal to use it.

Feedback is worthless, people will either leave it when they see it working and then it can never be changed and even if they waited months they can't leave feedback any more - hence the good feedback.

Honestly all you people saying 'but lol what can go wrong for £7, it's worth a shot' may as well just pirate it for free because it's about the same legitimacy. Do you really think a multi-billion dollar business like Microsoft sell this product for £350-ish or via 365 for £70/year have just 'accidentally' left this 'legit' loophole open and people happen to have just stumbled on it. Any excuse like, 'it's from a crushed PC' or 'at least I can prove I paid something' is about as watertight as 'I bought it from a stranger at the pub for cash and he looked honest'...

Firstly, learn to spell. Secondly, why should I go elsewhere with my comments? Too many dodgy ebay and other key sellers on here lately, maybe I'd like HUKD not to get shut down for promoting obviously illegal keys. And yes, loads of good feedback on ebay because people review as soon as they've bought and activated the product. Not 6 months later when it locks up as MS catches-up and deactivates the keys.

I have been buying these keys for years and only had one that didn't work and i got a refund thought P/P i don't know what all the fuss is about really even if in the end they did turn off you have only lost a few pounds .
I bought the windows 10 pro of this seller yesterday and thats all running fine and that was only £2.99p and now i have got the full Office for £6.98 what a bargin.

Good advise thats what i do like you say if it don't work go though PayPal and get your money back i always pay with P/P when buying from eBay or places that take P/P on the net just gives you a little bit more protection.

I try to get a good price, of course, but clearly Office 2016 Pro for £7 vs Office 2016 Pro from Microsoft or another authorised retailer at £350+ is quite a difference that should set alarm bells ringing. I accept that people always want a bargain and are willing to risk a few quid.

I imagine they would keep an eye on these things, ebay used to pull lots of adverts for MS software that they deemed breaking some rule or another.... they seem to let these dodgy deals slide by though, presumably because it earns them money!

I bought a few of these cheap keys a few months ago. worked fine for a while, then said they failed activation because they were unauthorised or something similar.

Now I use a free package called WPS office, which as far as I can tell is practically identical.

Correct me if I'm wrong but I believe the Sainsbury's deal is a one year subscription, and I believe this is the full suite to keep forever, but won't get full updates.

I know a youngster who needs Word for college, unfortunately the college don't give out Word etc.

How do you download 32 bit MS Office to use the key on? How do you avoid associating it with your MS account (it says to "sign in")? I'm ordering this for a youngster who needs it (Word) on their laptop for college (the college don't provide any free versions)

1. you do not need to tie a ms office product key with your "ms account"
2. in the eu, you can re-sell on an oem product key; there for it transferable to another machine

These keys are probably what they call a batch ome key(s) they will activate and everything but say in 2 year's time you need to format your machine and reactivate it won't anymore. Happened to me with cheap win8 key. Good price just have to bare in mind it may no reactivate later.

"License for only ONE Computer, CAN be used on the same machine." Before installation you associate the key with your Microsoft account just like you would add a Xbox live voucher. It is then connected to your Microsoft account and can not be redeemed by anyone else. The benefit of this is that you can re-download on the same machine in future.
