That's their own T&C's, which unfortunately for them doesn't take precedence over the law. Under UK Distance Selling Regulations you can open the packaging to inspect the goods, but you've a duty of care not to damage the items. It also extends to 14 days too, not the 10 they quote, which starts when you receive the goods.
Also, if you paid for standard delivery when you bought something, the seller has to refund this if you return it. You need to tell the seller you don’t want the item within 14 days of receiving it. Once you’ve told the seller, you’ve got another 14 days to actually send the item back.
Hope you got one...I ordered the only gold one, there were a few in black but have now sold out

With respect to OP.
The returns policy is a joke- they use the expression 'no quibble' erroneously.
"We provide a free 10 day no quibble returns service as long as the handset is returned unopened"
AVOID like the plague

I've used this company multiple times (100+ items), including this week. Always had great customer service. Had some iPads that were locked when they were supposed to be unlocked, got them swapped. Never had a problem.

So you want to send them a used product back? Once opened they can no longer sell as new and the price plummets.
You go to Carphone Warehouse and check it out, then buy from Smartfonestore. Don't know what the problem is.

not trying to be sarcastic here, but in terms of value for money, isn't x style better or good enough?

It's a lot of money to spend and find you are not 100% happy and then have to "explain yourself" to them.
Anyway looks like we disagree.

Didn't it get watered down slightly as well? Would be great to know the above still definitely applies.
OP3 went up recently to £329 but seems to be a much better deal.

Unless you want waterproofing, a 5.1 inch screen, expandable memory and a certain level of warranty support...

My advice would be don't get op3.. I returned mine after various problems one of which was it was going randomly into silent mode and I was missing calls.. Imo OP phones are glitchy and unreliable which is very frustrating

They are a used phone store, with the occasional unopened phone. You want to be able to buy from them, activate the phone, have a play around and then return it to them for a full refund? Use a high street store if you need that sort of service. But to get something really cheap and then want to return it after you have used it seems like an extreme case of entitlement.

Consumer Contracts Regulation 2013
Reimbursement by trader in the event of withdrawal or cancellation
34. (1) The trader must reimburse all payments, other than payments for delivery, received from the consumer, subject to paragraph (10).
(5) If the contract is a sales contract and the trader has not offered to collect the goods, the time is the end of 14 days after—
(a) the day on which the trader receives the goods back, or
(b) if earlier, the day on which the consumer supplies evidence of having sent the goods back.
(8 ) The trader must not impose any fee on the consumer in respect of the reimbursement.
(9) If (in the case of a sales contract) the value of the goods is diminished by any amount as a result of handling of the goods by the consumer beyond what is necessary to establish the nature, characteristics and functioning of the goods, the trader may recover that amount from the consumer, up to the contract price.
(10) An amount that may be recovered under paragraph (9)—
(a) may be deducted from the amount to be reimbursed under paragraph (1);
(b) otherwise, must be paid by the consumer to the trader. http://www.legislation.gov.uk/uksi/2013/3134/regulation/34/made

Makes perfect sense. Some people seem to think that they should be able to open and use and item for 14 days before deciding they don't want it and that it is poor customer service if you don't allow this.
