Think how many people they would have to ban! I'm pretty sure you won't get banned. You now may not even get access to online til midnight as it would be pretty unfair in the race to first prestige! They have a pre-load for digital version but the game won't actually work until midnight, I guess the same will be in place now for MP.
I'm sure I've played online before release in the past but it was a long time ago now as I lost interest after Ghosts.
